Daybrook dental compensation - What can I claim for?

what can i claim for

Normally when it comes to personal injury cases, the claim is made up of two parts. These are known as General Damages and Special Damages.

General Damages is for the pain, suffering, and inconvenience caused. This is normally based on how long you suffer as well as the extent of the suffering.

In cases like this, if you have been fortunate not to have contracted an infection or suffered from any form of disease as a result of what has happened at Daybrook, you may still be able to make a claim. This situation is similar to what a lot of people have claimed for in the PIP Breast Implant litigation that you may have heard - something that we are representing a large majority of patients for.

From when this story broke we were advised by NHS sources that the Arnold Health Centre, where tests are taking place for those affected, would be open for a period of two weeks. The following day we were told that the centre will now be operating for five weeks.

With potentially 22,000 patients to see, we expect it could take months for those affected to undergo testing and get their results. That's a long time to wait to find out whether you have been exposed to a blood infection as serious as HIV - no matter how big or small the risk.

The fact that people will have to wait for clarity and peace of mind is what we can make a claim for here. Let it not be forgotten just how serious and permanent particular infections can be, and the inconvenience of what has happened and having to go for testing can also be looked at.

If you have been unfortunate to have contracted any form of disease as a result of what has happened then your case can be dealt with by our Serious Injury Claims Team if you are left with a lifelong disease. There is a lot to look at and a lot to make sure you are compensated for in the event that the negligence of Mr D'Mello has left you with a serious blood-borne disease.

Losses and expenses

There may be a degree of losses and expenses caused as a result of the Daybrook scandal as well. Whilst they may be small, you can include them as part of the claim. We can look at things like:

  • Lost earnings from time off work for testing and results
  • Travel expenses to and from the Arnold Health Centre clinic
  • The cost of any medication or treatment where this may be applicable

The idea is that you are not at a loss whatsoever for being a victim of the Daybrook Dental Practice scandal. Just like any general claim for personal injury compensation you are entitled to losses and expense claims on top of the amount you can claim for the pain, worry, and inconvenience caused by this whole mess.

What to do!

Sources from the NHS as well as clients we are presenting who were former patients of Mr D'Mello have reported large numbers of people attending the Arnold Health Centre during their opening hours of 8am-8pm Monday to Sunday. People are being advised not to rush down to the health centre, but we are told that there are adequate numbers of staff to cope with the volume of people visiting the centre.

The helpline for general information is 03330 142479, although they are not based at the actual centre itself. They are advising people to visit the NHS England website for additional information which can be found here www.england.nhs.uk

People are being advised to visit the Arnold Health Centre for advice and testing and not their own GP or walk in centres / hospitals.

The health centre address is: Arnold Health Centre, Located at Highcroft Medical Centre, High Street, Arnold, Nottingham, NG5 7BQ.

We were advised initially that they would be open for a period of two weeks, but we have since been advised that the centre will remain open to handle the crisis for a period of five weeks. Given the volume of patients affected we expect this to be extended again; or the NHS may widen the availability for testing and information to handle the scale of the problem.

On site at the Arnold Health Centre there are information packs as well as staff on hand to advise people, and onsite testing kits as well.

The advice from the NHS on their website is as follows:

"We are extremely sorry for the undoubted worry and concern people may feel on hearing this news. We would like to stress that the risk is low but would encourage anyone affected to contact the advice line, or present themselves at the community clinic in Arnold, where clinicians are on hand to provide health advice on next steps."
