Do all personal injury lawyers charge a success fee?

April 2013 saw the government’s shakeup of the personal injury claiming world which has, in simple terms, left the innocent victims losing out.

For a long time now people have had fair access to justice by being able to make a claim for personal injury compensation and receive the full amount of their payout. They were entitled to recover all of their legal fees from the opponent, meaning they were fully compensated.

But the hugely influential and vastly wealthy insurance industry that has close ties to the government managed to change all that!

Now most law firms are taking at least 25% from your claim to cover their success fee which is no longer recoverable from the opponent. On top of that, many are charging additional percentages to cover other fees because the government also significantly reduced the amount that can be claimed back as well. Many law firms have upfront charges for administration costs or insurance fees. After The Event insurance cannot be recovered either.

Many people have no idea about these changes until they end up in an accident and needing a lawyer to represent them for a claim. It often comes as somewhat of a shock because most people are used to the idea of 100% compensation as a standard. Advertising for personal injury services has been popular for a while, but you may have noticed that most are not mentioning 100% anymore because most firms won’t offer it.

Unfortunately it isn’t our fault that the government have stopped you recovering all your legal fees from the opponent. The common amount charged is 25% because that is the maximum a law firm can take from you to cover their success fee now. But it doesn’t stop firms taking more for other fees.

So the big question on many people lips is this – do all personal injury lawyers charge a success fee?

Now, unless I spoke to every single law firm in the UK, I can’t really answer that. What I can say is that most firms will take at least 25%. But what I can also tell you is this:

  • For some case, we don’t have to take a success fee
  • For cases where we do, we don’t have to take the full 25%
