The Changes
In April 2013, the government stopped lawyers being able to recover all of their fees from the other side. They stopped us recovering a Success Fee and an After The Event insurance premium.
The Success Fee is a fee we used to be allowed to recover that helps us to fund No Win, No Fee claims as part of access to justice rules. Basically the insurers pay an extra percentage of our fees to help offset the fact some cases will lose; which we cannot find out until we have actually tried pursuing the claim.
The insurance is to protect you from having to pay costs to solicitors for the Defendant and to cover you for unrecoverable disbursements. Disbursements are items we pay out on your behalf and then look to recover back, like a medical report or a police report.
So now, lawyers cannot recover all of their fees and are now charging their clients a deduction from their final payout to cover the Success Fee and asking for payment of the insurance; sometimes upfront!
Wait, I thought you said the victim can get MORE money?
I suppose after reading the above you may be a little concerned. The topic of this article is all about how we can get more compensation for you; but the changes mean lawyers are now charging clients.
Well, here’s the secret: we are not charging the Success Fee or an insurance premium to our client!
