How Long Will My Claim Take?

Everyone knows that patience is a virtue; but a very common question we get here at The Injury Lawyers is how long will my claim take?

There is no absolute right or wrong answer to this question as every claim is as different as the person making it; in fact even if the same person makes two claims they won’t necessarily have the same facts or get the same amount of compensation.

While it is difficult to say that a claim will last an exact amount of time, we are able to give guidelines as to how long your claim should take if all goes well. However where there are complications in your claim, this can delay matters. These difficulties are usually issues that we cannot avoid.

A good example of this is where the other party to your claim denies liability. If the other party denies responsibility for your accident or your injuries, it can take a while to gather evidence and reports to show that it was in fact their fault. If after evidence is obtained the other party still do not admit your injury was their fault, then we may have to issue court proceedings for you.

Another possible delay could be that the other party to your claim are not willing to settle. All personal injury claims are covered by rules known as the Civil Procedure Rules and these are designed to allow claims to settle as quickly as possible and without the costly exercise of going to court.

However, some Defendant’s will try and frustrate this process; it is in these circumstances that your claim may go to court. While this may seem like an extreme step, we would not take a claim to court unless we felt it absolutely necessary to get the best possible outcome for you.

Injuries that will take a long time to get better are another reason your claim may take slightly longer to settle. The reason for this is that, in order to assess how much your claim is worth, we need to know how long you have been suffering with your injury for, and to do this it is always best to allow the time for your injuries to resolve before you settle your claim. This doesn’t mean you should wait before getting legal advice though as you don’t want to let your time to make a claim run out.
