“I’ve been in an accident! How much am I entitled to?”

It’s a very common question we here at The Injury Lawyers hear – and unfortunately it’s one we can’t give you a direct answer to! What we can do is give you the right advice and even a rough guide as to how much you are entitled to, however.

So to start with… how do we as independent expert personal injury solicitors value your claim for compensation? Generally speaking, the worse you suffer and the longer you suffer for are directly proportional to receiving more compensation. The extent of your suffering is the primary factor taken in to account. So how do we find this out…

Well, there is only one way – with solid, independent medical evidence.

During the claims process you will be seen by a local specialist consultant with years of experience in producing medico-legal reports. The report provides us with all the information we require to value your claim; which tells us the extent of your suffering.

Introducing the JSB Guidelines

So, once we know the extent of your suffering, how do we get to a figure? We use a combination of the JSB (Judicial Studies Board) Guidelines and past Case Law relevant to your case.

The JSB Guidelines provide us with a bracket which we can match to the information in the report. These guidelines are official guidelines used by Judges in court to value claims.

We also rely on case law; which is information from other cases with similar circumstances and injuries to the victim. We can look at the payout received and use it as part of the combination for valuing your claim as accurately as possible.

As specialist, personal injury solicitors with years of experience dealing with claims, we can use our own extensive history of cases as part of the valuing process!

For example:

For a minor whiplash claim, you are statically entitled to around £2,500 according to the JSB Guidelines; with the bracket stretching up to around £5,000.

For a moderate whiplash injury, the bracket extends up to £15,000.

Of course, other factors are taken in to account. For a personal injury claim you are entitled to more than just the compensation for your injury; in fact, what we aim to do is put you in a financial position that you were in prior to your accident.

What to expect:

The General Damages is the figure you are entitled to for your actual injury and suffering. The Special Damages is for any financial losses you have had that you are able to claim back for! Such as those outlined in the table above.
