What is the difference between 100% compensation and no win no fee?

Offering you a 100% compensation agreement and offering you a no win, no fee agreement can actually be two very different things. People commonly associate the two together because for years most solicitors for personal injury claims have operated on a no win, no fee basis and the client will keep all 100% of their payout.

On top of that, a no win, no fee agreement is the common term applied for a Conditional Fee Agreement which would in fact take in to account what you pay whether the claim wins or loses.

But now the difference between the two is very important indeed because nowadays most lawyers won’t let you keep 100% of your payout anymore.

What Does Legal Expenses Insurance Mean and How Would I Go About It?

Legal expenses insurance is a form of insurance that is designed to cover legal expenses – rather obviously! It’s common as an added extra on your motor policy and sometimes with home insurance or bank accounts. As it’s significantly more common with motor policies, I’ll stick to that as its most applicable.

If you have an accident that was not your fault, your motor insurers will likely advise you that you have the benefit of Legal Expenses Insurance (LEI for short) and that this allows you to have a solicitor and make a claim nice and easy. It is true, that it is an insurance policy, and your insurers can sue it with a solicitor; but there’s a hidden motive as to why your insurers want you to use it. In fact, you’ll likely find that they will be rather pushy to make you use it.

What is the Difference Between a Claims Representative and an Actual Injury Lawyer?

In short- a big difference! And one that can severely affect the service level you receive during your claim but also the final settlement!

“We have been trying to contact you regarding your accident; we now have details of how much you can claim”

The above is the classic example of correspondence from a claims handling company- it is highly unlikely that this is from a reputable solicitor’s firm. There are some major points that I will address in this blog which hopefully will show that a claims management company is NEVER the best way to go- ALWAYS seek your own solicitor to act on the case for you.
