Cosmetic Negligence Claims

cosmetic surgery negligence claimsCosmetic surgery is becoming more and more popular as the industry has shifted and now caters for everyone and not just the rich and the famous. Prices seem quite steep from what I’ve seen, but they are far from unaffordable if you want the look of your dreams.

But the big question that many people ask is this – how safe is cosmetic surgery?

Any surgery, particularly invasive surgery, carries numerous potential side effects and risks. Risks of infection are probably the most common ones, and infections alone can lead to all sorts of complications. But inherent risks aside, how safe is it when you put your life and body in the hands of a surgeon for money? How qualified are they to do the procedure?

Plastic Surgery Injury Claims Lawyers

Plastic Surgery Injury Claims LawyersAccording to Wikipedia: Plastic Surgery is a medical specialty concerned with the “correction” or restoration of form and function.

It is something that is always in the news; including very recently with Jackie Stallone speaking out about her regrets on having plastic surgery after suffering from her 3rd heart attack. But Jackie is if course not the only one that has fallen foul to the scalpel; other famous figures such as Michael Jackson, Pamela Anderson and David Guest are all examples of what plastic surgery can do. In recent years however, it seems that plastic surgery is no longer just something that the rich and famous pay for with many people now undergoing the knife to achieve the look they have always desired;  For example, in 2010 a total of 38,274 cosmetic procedures were carried out in the UK, compared with 10,700 in 2003 (source).

However, unfortunately not all of these procedures go the way the patient thought it would when they paid for the procedure, with negligence unfortunately happening in some.

Breast Surgery Injury Lawyers

breast implant compensation claimsWe are somewhat of an expert firm of injury lawyers when it comes to breast surgery. We represent a large proportion of the women claiming compensation for the faulty and dangerous PIP breast implants; a scandal which came to light in late 2011. So here is a little advice about the prospect of making a claim when breast surgery has gone wrong.

First things first, cosmetic compensation claims are not always easy to win. A lot can go wrong with any surgery, particularly surgery as invasive as breast augmentation. When it comes to implants, a foreign body is being put in to your body, and there are always risks associated with this.

So if something has gone wrong, we need to identify the cause and whether the problem has been caused as a result of negligence or an inherent risk.

For example, an infection is a very common inherent risk of most procedures like this. If you suffer from an infection, it can be difficult to claim because it is so common. Nothing much can be done to stop a general infection. So we need to clarify that the problem has been caused as a result of a mistake.

No Win No Fee Cosmetic Surgery Claims

no win no fee medical negligence claimsAs our name kind of infers, we deal only with claims for personal injury. But we don’t just deal with road accidents and workplace claims, we have specialist lawyers for medical negligence cases, and we have been taking on large volumes of claims for cosmetic surgery negligence over the last few years.

If you have had cosmetic surgery and something has gone wrong, can we help you out on a No Win No Fee basis?

Our No Win No Fee does exactly what it says on the tin. If we are confident that we can win your case, we can agree to represent you on a No Win No Fee basis. Normally this means that we are confident that we can win the case to the extent that we are willing to waive our legal fees in the event the case doesn’t win. If it doesn’t win, our legal fees are of course not recoverable from the other side. Yes, we incur a loss – but it is our decision as to whether we will work for you on a No Win No Fee basis or not.

Liposculpture (Liposuction) Compensation Advice

liposuction compensation adviceLiposculpture involves using ultrasound to break down fat before removal, and/or surgery to remove fat where it is excessive and potentially add it to other areas of the body with the aim to get a better shape. It is in many ways a form of liposuction.

In a world where appearance is everything, it isn’t surprising that many people now turn to cosmetic surgery to improve their appearance. The industry is worth a lot of money as people are willing to pay thousands and thousands of pounds to look as good as they possibly can.

As a leading law firm in the battle for PIP breast implant compensation, we know all too well that the industry in the UK is poorly regulated and procedures are on the rise. It’s therefore no surprise to our clinical negligence lawyers here at The Injury Lawyers to see an increase in the amount of people asking for our help to make a claim for compensation when things go wrong.

Cosmetic Surgery Compensation Claims

cosmetic surgery claimsCosmetic surgery used to be something that only the incredibly rich and famous could afford, with us all being  intrigued by the sudden change of appearance of famous figures such as (the most famous of them all) Michael Jackson. Even now, many glossy magazines often run stories about celebrities that may have had plastic surgery with “experts” in the field comparing photographs and guessing as to which secret procedure they have undergone.

However, when we think of these articles and photographs, our opinions don’t usually consist of comments such as “don’t they look good” or “you could never tell” – usually it is more like “that looks awful” and “why would you ever do that?!”. So why are millions still taking that plunge and going under the knife every year to change their appearance?

This question is one that unfortunately I do not have the space to fully answer in this blog; however in short it seems that we simply cannot get enough of trying to achieve our desired appearance. However, unfortunately, cosmetic surgery is not always the perfect solution it appears to be – like any other medical procedure, negligence and mistakes can occur which can leave disastrous and life threatening results.

Eyelid Surgery (Blepharoplasty) Claims

eyelid surgery claimsTo you and me this is the surgical modification of the eyelid and can involve surgery on either the top lid, bottom lid or both. It is designed to turn back the clock on the area some consider to be the main one that “tells your age” – the eyes.

The procedure usually involves the removal of excess tissue, fat and skin which then requires removal or repositioning of the surrounding muscles. When done successfully, it can be life changing for those that have suffered with “ageing eyes” before their time or can simply give people their desired look. However, with such as invasive procedure of course comes the risk of negligence and consequently injuries that were not expected during the initial consultation.

There are obviously many inherent risks with cosmetic surgery and these should be explained to you in your initial consultation. It is important to understand that injuries arising from inherent risks are incredibly difficult to claim for as with all surgery – be that cosmetic or life saving – things can unfortunately go wrong.

Cosmetic Surgery Review

cosmetic surgery reviewAs you may have seen or heard, some of the recommendations for changes in regulation to the cosmetic surgery industry have been released. This review, commissioned by the department of health in the wake of the PIP breast implant scandal, has investigated in to how best to protect patients who chose to undergo cosmetic procedures, something that is incredibly popular in this day and age.

The Cosmetic Surgery industry is a very lucrative business and is forecast to be worth about £3.6bn by 2015. The overall feeling I get from this review is that the attitude to cosmetic surgery needs to, and is going to, have to change with several comments referencing that getting such invasive treatment appears to be as normal as buying “double glazing” or walking in to have your hair done at a hairdressers with Sir Bruce Keogh, NHS medical director for England, describing the situation as “bizarre”.
