Sale of Goods and Services Act 1982

sales-of-goods-actEver heard of it? Its legalisation in place as the guidelines for legal disputes involving products and services sold. And it’s very important!

It covers everything from the liability a manufacturer of a product has to the consumer, to the liability a tradesman has for a service he/she provides. When it comes to personal injury, it is important when establishing liability if a person is injured as result of a defective product or a dodgy service for example.

Big, Scary Rides Made Scarier!

scary-ridesI was recently at Hull fair a few weeks ago (it travels around the country, and was recently in Nottingham as Goose Fair) and it got me thinking about the strict health and safety legislation operators and ride manufacturers must adhere to.

I think it would be hard to find anyone who isn’t a fan of amusement parks and fairground rides. There are of course some of us (myself included) who are a little more inclined to the bigger and scarier rides to quench a thrill seeking thirst!

So it probably goes without saying that all rides (in particular the big ones!) are put through stringent health and safety checks to ensure nothing can go wrong. And there have been stories recently and in the past whereby negligence has resulted in ride users being seriously injured, or worse. Not to put anyone off the big ones of course!

How Much is Your Claim Worth?

worthSo how does it work? How do we know as expert personal injury solicitors know how much your claim for compensation is worth?

In the majority of personal injury cases, a medical examination (at no cost to the claimant of course!) is arranged for a specialist consultant to examine the injured victim and produce an in depth medical report detailing the accident and the injuries to the claimant.

More on CICA Claims and Premeditated Attacks

violent-attacksRandom attacks by strangers are at the highest level in more than a decade according to recent press reports, which has linked the figures to Labour’s time in government and  the introduction of the 24 hour drinking licenses.

The Daily Mirror reports that figures have indicated that a person is attacked by a random stranger every 30 seconds in Britain, and that there were 1,057,000 violent attacks by strangers last year; the equivalent to 2,895 every day or 120 per hour.

The report also indicates that only a third of violent crimes involved the victim not knowing the assailant when Labour came in to power which has jumped to half as random violence, fuelled by alcohol and round the clock drinking licenses, is on the rise.

The Tragedy of Medical Negligence

medical-negligenceDoctors, surgeons, nurses, and all health workers charged with the care of those who are ill or injured have a duty to ensure that the procedures and medicines they practice and provide are safe and adequate.

Medical Negligence: the term itself is straight forward; for example medical staff failing to sufficiently examine and diagnose a patient or administering the wrong treatment.

So it’s never nice to hear about a serious medical negligence case that has resulted in the death of a young boy; particularly when it could have been prevented.

Premeditated Injuries!

ambulancePersonal injury works on the law of tort (negligence); whereby if a person is injured as a result of another person accidentally causing them to come to harm, the injured party has a right to pursue the negligent party for compensation.

So what happens if you are injured as a result of a premeditated attack or assault from a third party?

You still have a right to claim for compensation through the Criminal Injuries Compensation Authority (Aka CICA) – www.cica.gov.uk

Motor Mania

dangerous-drivingIt appears the number of news articles centred on dangerous motor vehicle incidents are on the rise at the moment. Of course these stories are never nice to read about, particularly with the onset of the winter weather and driving conditions worsening.

You may have heard in the news recently of the police officer’s joyride that resulted in the tragic death of a grandmother, BBC news reports (source).

Autumn Anarchy

autumnFurther to discussions in recent articles, the turn of the weather as the clocks go back, the skies go greyer, and the air gets colder sees an increase in accidents as a result of the winter weather.

And it’s not just the wetter roads and darker skies that lead to increases in all sorts of accidents.

According to a mirror.co.uk report, car owners have been warned that the autumn leaves, as pretty as they may be, are the cause of crashes due to the leaves affecting onboard computer systems that many modern cars are fitted with nowadays (source)

Causing Car Accidents Under the Influence!

dont-drink-and-driveUnfortunately there are still people out there who take the wrong decision to jump behind the wheel of a motor vehicle whilst under the influence of alcohol or narcotics; and it’s no secret that it’s a major cause of road traffic accidents around the world.

So what are the rules and legislation regarding being under the influence and on the road? It depends on the circumstances of course, but the gist Section 5 of the Road Traffic Act 1972 details clearly that a person found to be under the influence or alcohol or narcotics is guilty of offence (source – opens as a pdf).
