Work Equipment Injuries – Training Issues!

The Law

There is a duty under The Provision and Use of Work Equipment Regulations for employers to make sure staff are trained when it comes to using work equipment. The applicable parts of the regulations state:

9.  (1)  Every employer shall ensure that all persons who use work equipment have received adequate training for purposes of health and safety, including training in the methods which may be adopted when using the work equipment, any risks which such use may entail and precautions to be taken.

(2) Every employer shall ensure that any of his employees who supervises or manages the use of work equipment has received adequate training for purposes of health and safety, including training in the methods which may be adopted when using the work equipment, any risks which such use may entail and precautions to be taken.

The regulations are fairly clear in the way they read. There is an important duty that lies with the employer to ensure that staff are properly trained in how to safely use work equipment. Proper training when it comes to dangerous equipment is more than just a quick five minute tutorial. If there are clear risks to your health when using equipment, you need to be fully trained and supervised for a period to ensure you can, and are, using equipment correctly and safely. It’s important you are confident in being able to use the equipment safely.
