We offer 100% compensation for pothole compensation claims!
Potholes – they can be a real pain in the backside when we are forced to dodge them on the roads and pavements. Falling by stepping in one or tripping due to one, or driving over one in a vehicle or on a bike, can lead to some fairly serious injuries.
The council may be responsible to compensate you if this has happened to you, so read on for more info about how it all works.
Can you claim?
Winning a claim is normally down to what knowledge the council had of the pothole. If it’s on private land like on a supermarket or a car park, then similar laws can apply for whoever owns/ is in control of the land,
If they have no knowledge of the defect, then it comes down to proof that all reasonable steps have been taken to prevent an accident occurring. For a council claim, the Highways Act applies; on private land, the Occupiers Liability Act applies; and if it’s in the workplace, The Workplace (Health, Safety and Welfare) Regulations 1992 apply. All generally place a duty on whoever is in control of the area to take reasonable steps.
Reasonable steps would normally be systems of inspection and maintenance. On private land or in the workplace, you’d expect this to be fairly common as people of authority like staff may be there all the time. On public land however, it’s down to systems of inspection based on how frequent the area is used. Inspection intervals can range from monthly to annually – so if they can prove a pothole has appeared in between inspection periods, they can defend the claim.
