100% Compensation for Fall Accident Claims

We can still give you a 100% compensation agreement!

Fall accidents, whether caused by trips, slips, or from falling from a height at work perhaps, can cause some pretty devastating injuries; especially if you fall from a significant height and / or the ground you land is hard. So if you are the victim of a falling accident and you think you may be entitled to make a claim for personal injury compensation, how can you get a lawyer to guarantee you can still keep all 100% of it?

Firstly, heads up – the law has changed!

First thing to mention is that most lawyers won’t let you keep 100% of your compensation anymore. The reason for this is that the law was changed in April 2013 and the changes stopped lawyers recovering all of their fees from the other side.

Now, we cannot recover a Success Fee or an After The Event insurance premium. For more info on what these are, follow this link. But the thing you need to know for this article is that now a lawyer can take up to 25% from your payout to cover their Success Fee and they may ask for an upfront payment of a few hundred pounds for the insurance.

So 100% compensation is a thing of the past?

Well, for most law firms, yes. The Success Fee is actually designed to help cover the risk of taking on a claim and not winning it as most lawyers operate No Win, No Fee guarantees. Sometimes, which is often the case in fall accidents, we simply don’t know if you have a claim until you actually pursue it. So there is a risk the law firm won’t get paid, and the Success Fee on a wining claim is designed to help offset losses lawyers incur on losing claims.

But we, for most falling accidents, will still let you keep all 100% compensation of your compensation.

When can we offer you 100% for a falling accident?

There are many circumstances where we can offer you a 100% compensation agreement for a falling accident such as:

  • Falls caused from slips and trips
  • Falls from ladders or from working at height in the workplace – especially where ladders are not suitable / defective, or where guards or equipment should be there to prevent falls
  • Falls caused by defective or missing manhole covers

We still offer it because we agree to waive the Success Fee deduction that other lawyers will take from your payout. We also self insure the case so you don’t pay for insurance either. So whatever happens, whether you win or lose, you don’t face any deductions or costs so long as you comply with the agreement we have.

100% compensation – it can’t get any better really! Most law firms will take 25% as that seems to have settled as the standard amount to take given that the law has capped the Success Fee charge to clients at a maximum of 25%. But with us, you can save yourselves a shed load of money by not facing a huge costly deduction that is likely to amount to thousands of pounds.
