Electric shock claim from broken / defective product

100% compensation for product claims

So, you’re using a hairdryer, or perhaps a lawnmower, or some other form of electrical equipment, and it shocks you – causing an injury. What can you do?

If the electric shock is caused because the product is defective, or perhaps the plug or wiring is faulty, you may have a claim for personal injury compensation depending on how it has happened, and where it has happened as well.

The Cause – Products

If the product is defective and the defect has been caused because of a manufacturing error or problem from where you bought it from, you may have a claim against either the manufacturer or even the supplier. The Supply of Goods and Services Act leave both the manufacturer and supplier potentially liable, so you can sue either of them.

If the product has been damaged due to wear and tear or you have damaged it, that would of course make a claim difficult to win against a supplier or manufacturer. The burden of proof is on you to prove the claim – so bear that in mind, and remember we must prove they have been negligent to have caused the electric shock themselves.

The Cause – In a rented house or public place (like a hotel)

If an electrical fault has occurred with either a plug in a rented property or perhaps in a hotel or other public place (like a train for example) or with electrical good provided to you (like a hairdryer in a hotel) then you may have a claim against a landlord or person in control of a premises. If a landlord has failed to maintain the property and that’s caused the electrical shock, they can be liable. If a plug or electrical good provided as part of a hotel service causes it, the owners of the hotel (persons or company) can be liable.
