Who was at fault?

In order to make a claim for compensation your accident must have been down to the negligence of another party. In say this there can be some fault on your side which still means that you could claim, but that you may have your compensation reduced depending on how much fault was apportioned to you.

I have set out below some examples of where you are likely to be found not at fault:

  • Slipping on a spillage left negligently uncleaned in a supermarket and thus injuring yourself as a result. In this instance a claim can be made against the supermarket as a company.
  • Falling down an uncovered manhole that was not adequately cordoned off and /or no warning signs were surrounding it. In this instance a claim may be made against the person/body responsible for it, this may be a local council, a water company or a gas and electricity company.
  • Being hit from behind in a road traffic accident. This type of accident is known as a rear-end shunt and often it is very obvious who is at fault.
