The Injury Lawyers win £14,000 settlement for ladder fall at work claim

In this case, our client was asked to carry out a task using a ladder to repair a fence on a building site. Failed to diagnose knee ligament injury – Claim advice!

Any claim for medical negligence can be inherently difficult to win. The reason for this is that certain injuries are not always easy to identify. Sometimes follow up appointments need to be made and clinicians need to wait to see how symptoms develop before taking action and making a proper diagnosis.

But sometimes, things are simply missed.

A knee ligament injury can result in serious and lifelong suffering and potential disability. It’s therefore important to get the right standard of care or you can end up unnecessarily suffering or being worse off if action isn’t taken early on enough. Even a simple tear can become a serious problem if not treated early on, with ligament ruptures often being the worse.

Sustaining a knee injury from kneeling can be easy to do – and unfortunately knee injuries can result in severe and long term disability. So it is important that employers abide by the law. Engineers, plumbers, electricians – anyone who may have to work in small spaces on their knees should be provided with things such as knee pads and soft matting to kneel on.

Knee Injury Claim Amounts

How much are you entitled to claim for if you sustain injury to your knee? Well it all depends on the nature and severity of the injury. When it comes to knees, they can range from a simple twist and strain that leaves you uncomfortable and limping for a few weeks, to ligament ruptures requiring surgical reconstruction and a permanent weakness. It really all does come down to the nature of the injury.

The only way to properly value a knee injury compensation claim is to instruct an expert lawyer and see a suitable expert for a medico-legal appointment. A report from the appointment will then be used by the lawyers to value the injury.

But in the meantime, here is a little guidance based on the official guidelines that are used to value knee injury claims:

“I’ve been in an accident! How much am I entitled to?”

It’s a very common question we here at The Injury Lawyers hear – and unfortunately it’s one we can’t give you a direct answer to! What we can do is give you the right advice and even a rough guide as to how much you are entitled to, however.

Generally speaking, the worse you suffer and the longer you suffer for are directly proportional to receiving more compensation. The extent of your suffering is the primary factor taken in to account. So how do we find this out…
