skidding on icy roads claimsAs the weather gets colder, the roads are set to become more and more dangerous as Britain is (apparently) going to be facing one heck of a winter. That means ice on the roads making driving conditions perilous, and snow that will probably bring our country to an unnecessary standstill as it always seems to do!

Anyone who is a capable driver knows to take extra care in icy and snowy conditions because skidding is a real risk. If you hit a patch of ice, you will very likely lose control of your vehicle and regaining control of it may be completely impossible.

workplace accidents

Did you know that there is a specific regulation that addresses the condition of walkways and traffic routes in the workplace?

You do now! Regulation 12 of The Workplace (Health, Safety and Welfare) Regulations 1992 specifically places a duty on an employer to:

(1) Every floor in a workplace and the surface of every traffic route in a workplace shall be of a construction such that the floor or surface of the traffic route is suitable for the purpose for which it is used.

slipping on stair claimsA fall on stairs can be, for rather obvious reasons, very serious and potentially devastating when it comes to injuries and losses that can be commonly associated with these types of accidents.

It can be bad enough having a general slip, trip or fall but ending up down a flight of stairs is likely going to be much more serious.

So what can you do if you have injured yourself due to a defect or a hazard on some stair? Perhaps one of the following has happened to you:

beware insurance companies offering low payouts at xmas timeIt’s that time of year where the insurers will prey on victims of accidents and push them to settle too early and directly without a solicitor because Christmas is here and everyone could use a little more money over the festive period. Even our clients get a massive surge of pre-medical offers, which are offers to settle claim without medical evidence.

It’s tempting to take the common £1,000 now rather than wait a few more weeks and settle a claim the proper way.

roundabout accidents and injury claimsTraffic in Derby around the Markeaton roundabout is being seriously delayed after an accident involving a lorry and a Nissan Micra earlier this morning.  This is on my usual route to work; as I attempted to join the A38 the whole carriageway was blocked by a two trailer lorry with the rear trailer having tipped over across the lanes. According to sources from the Derby Telegraph no one was badly hurt.

But it got me thinking about roundabout accidents once again, as I have had plenty of near misses (none my fault!) myself when drivers cross lanes and pull out in front of you. And although, thankfully, no one appears badly hurt in this incident, it got me thinking about the “what if’s” in a situation where vehicles are involved in a serious accident on a roundabout.

medical negligence

Firstly, I’ll define what I mean by the term “free” – by this we can organise funding of private medical care that we can then recover directly from the other side at the end of a successful claim. So it isn’t provided free of charge, but you won’t have to pay out for it so long as you comply with the terms of the agreement.

bad weather accident claimsI was out in town earlier and even I was almost blown over by the significant power of the winds today. The UK is being hit by a huge weather front that is causing chaos for everyone as winds of up to (I’m told!) 100mph are damaging property and making a mess of the roads. My drive to work this afternoon was somewhat of a slalom exercise as I dodged branches and bits of trees that had come down in the winds.

It’s not uncommon that accidents can easily occur in times of adverse weather. Road accidents can be caused by drivers either going too fast or not keeping a full hold of their steering wheel as winds are powerful enough to jink your car whilst you’re driving. A driver could easily end up losing control of their vehicle as a result. On top of that, people are dodging debris in the road which is potentially putting other road users at risk as well.

why you require medical exam in injury claimsIt’s very common for people to see a medical expert as part of their claim for personal injury compensation, and this is usually arranged by your lawyer. But why?

The expert you see will produce a report for your lawyer which they will then use to:

  • Value your claim for compensation.
  • Justify any losses like lost earnings, medical expenses, or travel expenses.
  • Find out if you need further investigation or treatment to assist your recovery.

This report, known as a medico-legal report, will give a solicitor the valuable information they need to determine the extent of your suffering and loss to allow them to use a combination of their own expertise and experience, together with official guidelines, to value your claim. In the absence of such a report, your solicitor can only ever give you estimates.

100% compensation claimsApril 2013 saw the government bury years of access to justice when they stopped lawyers being able to recover all of their client’s legal fees from the opponent if the case wins. The result is that other lawyers are now taking up to 25% from their clients compensation claim to cover a Success Fee which is no longer recoverable. This fee is designed to help fund No Win, No Fee claims and allow people the right to make a claim if they have been injured through potential negligence.
