There is a piece of very important legislation called The Package Travel, Package Holidays and Package Tours Regulations 1992 which puts a duty on package holiday providers to compensate victims of negligence. It is by no means straightforward though because standards abroad are often not as good as our standards here, and that can be used as a defence to a claim.
Package providers will commonly try and defend these claims and it’s key to instruct an expert law firm like us to give you the best shot of winning your accident abroad claim.
It’s the nightmare situation – you’re supposed to be abroad enjoying your holidays when you slip on a wet floor like our client did in this case. Our client injured her elbow as a result, and whilst it wasn’t life altering, it was painful and caused a real problem given that it happened abroad.
It can be scary being involved in an accident abroad. How do you know that the doctors you see are as good as the ones here in the UK? Standards are often different when it comes to medical treatment as well and it can be understandably terrifying to have to go through something like this in a foreign country.
Our team are here to help you when you get back home and we are here to make sure that you are fully compensated for what you have had to go through.
In this case, the solicitors for the defendant side ruthlessly denied liability for the case. They alleged that wet floor signs had been deployed even though our arguments were that this was not the case. They called in to question the difference in local standards which is often a hard defence to conquer because, like I said above, standards are often not as high abroad as they are here.
We proceeded. A lot of lawyers may not have done because the risk of continuing to work on a no win, no fee basis for a risky case like this is not something that all law firms can afford to do. But as expert injury lawyers we know when we see a case that can be won and we are prepared to put our money in to fighting for it.
We eventually managed to persuade the defendant to make an offer which was acceptable for our client. This is another example of the defendants trying to fight a case for a long time and our expert team turning it around, even where the odds were against us.
Like I said earlier, some lawyers are not prepared to fight for some cases on a no win, no fee basis but The Injury Lawyers are not like most other firms. When we say that we really will give our clients the best chance at settling the case, we mean it.
