In this case, our client was burned from their wrist to the elbow at work which was caused by being exposed to condensed boiling water and hot soup that had reached scolding temperatures.

Our client was retrieving a container from an oven that was covered with cling film which had split, resulting in scolding hot water that had condensed on the film to run down and contact his arm. It was a problem that had been reported before yet the company he worked for, who were contracted by major supermarkets at the time, had failed to take action.

We were successful in persuading the insurers for our client’s employer to accept liability and we instructed a plastic surgeon to assess the injuries and provide a report for us to value the claim. The injury damage was extensive on the arm and had caused a large surface area of our client’s skin to burn pink and peel and leave some minor discolouration.

Luckily the burns were not damaging enough to cause any injuries to the underlying muscular tissue but they were enough to cause a superficial scar, and our client was pleased to accept an offer of £7,000 which was made to reflect the initial period of pain he suffered and the superficial scarring that remained.

In burn injury cases the value of the claim commonly comes down to the severity and extent of any scarring caused. Unless there are any complications like infections or muscular damage, the pain and suffering period doesn’t usually last a long time. But despite this burn injury claims can attract higher than usual awards because the payout is intended to take in to account the scarring.

The value can then depend on where the scarring is; how large the area affected is; how bad the scarring is; and similar such factors.
