My GP wont refer me – help!

Can I claim if my GP won’t refer me?

If your GP wont refer wont refer you and this has resulted in you suffering complications, or suffering unnecessarily, then you may have a claim to make. If you discover that you could, and should, have been referred at an earlier stage, and the fact that you weren’t referred has led to problems, you may have a winning claim.

In any medical negligence case we typically have to prove two things: breach of duty, and medical causation.

Breach of duty is to show that you were not referred in time, or at all, when you should have been. If our privately instructed expert says that you should have been referred then that can help to prove the breach of duty side.

For medical causation, this is to show that the breach of duty (i.e. the failure to refer you) resulted in you suffering. Typically this is, as referenced above, further undue suffering and/or complications. For example, if you suffer six months longer because the GP didn’t refer you until then, or at all, and you went on to have the treatment you needed, you may have a claim for six months of unnecessary suffering. Or, if the condition or injury worsens because it hasn’t been dealt with in time, you can claim for whatever this does to you.
