Uneven walkways health and safety – can you claim?

Uneven walkways can be very dangerous indeed. Trust us as a firm of injury lawyers when we tell you that we have taken on and settled countless claims involving dangerous and uneven walkways and traffic routes resulting in trips and falls.

So if you are the victim of an uneven walkway, can you make a claim for personal injury compensation?

Read on for some more advice.

Generally speaking the owner or occupier of a premises has a duty to ensure that you are not exposed to any risks that could be preventable. Whether this is a supermarket company, a landlord, or even your employer, they can all have a duty of care.

In workplaces there is actually specific regulations that address uneven traffic routes that state that the floor, or surface of the traffic route, shall have no hole or slope, or be uneven. It’s clear to see there is a duty here that an employer must adhere to.

If it’s a public place then we have The Occupiers Liability Act which states that the occupier or owner of a premises should take all reasonable steps to prevent people being injured on their property. A dangerously uneven walkway can be seen as a breach of this duty and we would argue that they are liable to compensate you if you have fallen as a result of such an occurrence.

How uneven does a walkway have to be to be seen as dangerous?

It can depend and can be different on a case by case basis. It could depend on the steepness of any inclines or the severity of any rough areas – whatever makes the walkway ‘uneven’ by definition. It could depend on the use of the walkway; an uneven surface in an elderly care home could be more of a danger than the same degree of unevenness at a sports hall, for example.

The best thing you can do is take some photos and call us to speak about the claim and we can assess the images which can help us decide whether we can help you or not.
