Have you had a fall on a loose concrete step?

If you have been in an accident as a result of a loose concrete step you may be entitled to make a claim for personal injury compensation. If the accident happened on public land then the local council or highways authority will be the likely organisation to claim from. They have a duty under The Highways Act 1980 to have and to uphold a system of inspection and maintenance to rectify hazards. On top of the duty they have to inspect and maintain areas, they also have a duty to rectify or make safe hazards within a reasonable timeframe when they are reported.

If the loose step is on private land like a private car park or a shopping centre then you can sue whoever owns or is in control of the land under The Occupiers Liability Act. This places a similar duty on the occupiers of the area to take all reasonable steps (no pun intended!) to maintain the area in an efficient state and in good repair.
