Medics failure to treat compensation case against University Hospital of Wales

A lot of the medical negligence claims we represent clients for, come down to a medical professionals failure to diagnose and / or treat a patient; or a failure to refer to a specialist. Delays that can be caused can result in undue suffering and sometimes serious complications.

In a news article from the BBC, the family of a patient who died after medics allegedly failed to treat her adequately following major heart surgery have been awarded compensation from the University Hospital of Wales.

In this tragic news report, the case of Margaret Parsons who died at the age of 63 in 2010 was taken to London’s High Court. The case surrounded the allegations that the medical staff failed to properly care for Mrs Parsons which led to her condition deteriorating. She eventually suffered a major cardiac arrest that led to brain injuries, and later her passing.

The NHS denied all liability for the case for mismanagement against them, according to the report. But after what appears to be a lengthy legal battle the family have been awarded compensation and it is now hoped that this tragic chapter of their lives can be put to rest. In comments from the Judge Mrs Justice Swift, the settlement has been described as ‘a “common sense” deal which avoided the risks of highly complex litigation.’

Clinical negligence is a complicated area of law that requires particular expertise and specialism to fight. Funds are put aside for victims of negligence to claim from where the NHS has genuinely failed in its duty of care to patients.
