Is it safe to sue my employer?

A lot of people are either nervous or entirely put off by the idea of putting in a claim against their employer. Many will make enquiries with law firms and back down when they get the paperwork because of the fear associated with claiming damages from the company or person that keeps you financially afloat!

It’s natural and entirely understandable to feel this way – but the aim of this blog is to change your mindset and make you realise that, really, you have nothing to fear at all!

Protection in law

You cannot be dismissed or treated any differently because you are making a claim where you have the right to do so. If you were injured and the law says you are entitled to compensation, if your employer gives you the boot because you are making a claim, they would likely have an employment claim on their hands as well!

So don’t worry – the law is on your side and I’m sure they wouldn’t want to risk being sued again for unfair dismissal!

A normal and natural process – it’s nothing personal!

Did you know that all employers have to have mandatory insurance to cover their employees for negligence? You do now!

This insurance exists for the sole reason for people injured at work just like you to make a claim from. It’s really not that different to claiming of your contents insurance if you get burgled – the insurance is there to be used when it is needed.

Many employers have little involvement in the work injury claim and will pass it all straight on the insurers to sort out for them because that’s their job. In fact, many employers actually tell people to get a lawyer and make a claim when an employee has genuinely been injured at work.

Many employers recognise and understand the need for you to make a claim and have probably been sued thousands of times before anyway. The insurance is there – use it!
