What to do when you are not given protective equipment at work!

Have you had an injury because you weren’t given proper protective equipment? Protective equipment can be hard hats, goggles, gloves; a whole host of things. If you should have been better protected at work, you should be entitled to make a claim as it is NOT your fault that your employer has failed to protect you.

In this blog we hope to underline the main points of Personal Protective Equipment claims and how it can help you get the compensation you deserve.

What is Personal Protective Equipment?

Personal Protective Equipment, by definition, is any equipment that is required to help keep you safe when performing any task at work. This can range from hard hats to safety harnesses, or respiratory equipment.

Should my employer provide Personal Protective Equipment by law?

It is part of your employer’s duties to supply Personal Protective Equipment – they should be committed to protecting you from any harmful or unsafe situations when performing a task they have set for you. This includes preventing injuries to:

  • The head and feet, from falling objects etc.
  • The lungs, from breathing contaminated air
  • The skin, from any burns by corrosive substances
  • The body, from extreme heat or cold

Failure to provide this protection means your employer may be guilty of negligence by putting you in potentially dangerous situations without the proper protection. There is legislation, aptly named The Personal Protective Equipment Regulations, that outline the duties of your employer when it comes to providing such equipment.

It’s their job to:

  • Provide and pay for it
  • Ensure it is suitable through risk assessment
  • Train you in using it correctly and safely
  • Inspect, maintain, and replace it when necessary

Should I claim?

If you have suffered an injury as a result of your employer giving you a task that is potentially dangerous and not providing you with any or any adequate Personal Protective Equipment then you should make a claim as it wasn’t your fault.
