Fall on debris or rubbish in a warehouse – advice from The Injury Lawyers

100% compensation for work accident compensation claims

Warehouses can be inherently dangerous places, and they are often fraught with potential hazards. Employees who work in a warehouse are clearly at risk of injury, so health and safety standards in a warehouse must be particularly high!

So what are your rights if you have had a fall in a warehouse due to rubbish or debris in the warehouse being a hazard? Can you make a claim for personal injury compensation?

The Law

Under Regulation 12 of The Workplace (Health, Safety and Welfare) Regulations 1992, your employer has a specific duty when it comes to the conditions of floors and walkways in the place of work. The relevant part for the purposes of this article states:

(3) So far as is reasonably practicable, every floor in a workplace and the surface of every traffic route in a workplace shall be kept free from obstructions and from any article or substance which may cause a person to slip, trip or fall.

So there you have it – there is a duty on your employer to ensure that debris and rubbish does not allow to accumulate in walkways or in traffic routes and cause a hazard. As such, there should be policies and training for staff when it comes to the safe disposal of such things, and bins and other receptacles should be provided to allow for this.

There should also be general inspection and cleaning regimes as well to make sure any hazards are spotted and sorted out right away.
