What You Should Know About Product Liability Claims

understanding product liabilityHave you been injured in an accident due to a faulty product you recently bought? No matter how minor or serious your injury may be, you may be able to claim compensation for it.

The Supply of Goods and Services Act 1982 states that, as a consumer, if you are to be provided a good or service, you enter into a contract for those goods and/or services. As such, it is acceptable for you to expect that reasonable care and skill has been applied to the product / service that you have been provided.

What exactly is meant by ‘services’?

The term ‘service’ basically means any work that has been carried out for you; for example, repairs or fittings. It is important to remember that services may either be provided alone or with goods that have been purchased. An example of services which may be provided with goods is if you were to buy a new kitchen, where normally you would expect a service of fitting it into your home to be included with the purchase. Services which may be provided without actually buying a product could be work carried out by professionals such as Doctors, Estate Agents, dry cleaning, entertainment, or cosmetic surgery.

As a consumer, in accordance with The Supply of Goods and Services Act 1982, it is expected that services purchased should be carried out with reasonable care, skill, time and charge. When concerning goods and services which have been purchased, the term ‘reasonable’ implies that both or either of these must be fit for the purpose which they were bought for, as described, and of satisfactory quality.

What if I believe the service and/or product I have purchased is of unsatisfactory quality and because of this has caused my accident and injuries?

If you believe this is the case, then ideally the first thing you should do is write to the trader, that you bought the product or service from. The reason for this is that if the store or shop writes back to you accepting their liability for your accident and injuries, then this could count as evidence to support your claim. Other evidence such as photographs and videos of the injuries and the faulty product or service would also be very beneficial in supporting your claim.
