Negligent Gastric Band Surgery Claims

Weight loss surgery has undoubtedly become increasingly popular in the recent years as many people either give up on the diet and exercise or simply feel that these options have not done anything for them in previous attempts to lose wight. However, although often advertised by celebrities who basically brag about how good they now feel and how nice they look in a bikini, the surgery is not one that should be undertaken lightly. At the end of the day, it is incredibly invasive and can result in serious injuries, including death, if there is some form of negligence.

Now of course, the majority of these surgeries happen without a glitch; but if something goes wrong due to the negligence of a medical practitioner, what happens then?

There are several types of bypass or “gastric” band surgery including a bilipancreatic diversion and a Roux-en-Y. Basically, in layman terms, there is a large gastric band surgery and a small one and unfortunately the former can be riskier as it’s a huge operation.  When you go for your consultations the consultant will confirm what type of surgery they believe will be best for your body and individual needs. One example of a problem is called “dumping syndrome”. This is where food bypasses the stomach too quickly and enters the small intestine hardly digested. This can cause extreme discomfort and malnutrition which may affect you every day and working life greatly.

Further injuries can include:

  • Slipping of the gastric bands
  • Gastric bands been fitted incorrectly- either in the wrong place or at the wrong angle
  • Failure to bind the wounds correctly resulting in leaks
  • Damage to other organs during careless surgery
  • Abdominal hernias caused by aggressive surgery

All of these can be extremely damaging, and can even lead to death.
