Legal Expense Insurance – The Truth

Personal injury claims are on the increase.  Therefore, it comes as no surprise that more and more people are competing to represent you in your claim.

At The Injury Lawyers, we want you to make an educated decision regarding which law firm is best for your claim.  The trouble with this is how do people get educated and so learn how to pick the good guys from the bad?

Many clients who come to us have been approached, or are about to be approached, by their insurance company. Their insurers inform them that they have Legal Expense Insurance attached to their policy; the client may even be paying for the privilege of having this. They say this entitles them to free legal representation in their personal injury claim.  Now, this is true, however, it is common for you insurer to sell your claim to solicitors who will buy it for a referral fee.  This fee can be as much as £800, and so the solicitor may not have a large margin to make on your claim; thus possibly giving you a less than decent service. With less money to spend on your case from the outset, how will they fund your claim efficiently?

Now it may be true that by taking this route you get free legal representation, but at most good no win no fee law firms, there are no costs to you anyway (obviously depending on the terms of the agreement you sign which should be carefully checked before signing).   By going to a law firm directly, there are no middlemen to pay for your claim – your lawyers will have more money to spend on your case – providing you with a better service.  Plus, you are not putting the destiny of your claim in to the hands of a lawyer who has wasted a huge amount of money on buying your case rather than giving you an excellent service.

Importantly, you should be informed by your insurers, and you MUST be informed by your solicitors if a referral fee has been paid – so check the small print, as its usually hiding in there.

So, the moral of this story is to directly instruct your own independent law firm working on a genuine no win no fee basis.
