Private treatment with compensation claims: how it can work

It’s possible to include the costs of private treatment with compensation claims and there are a number of ways in which we can do this.

In some cases, we can agree for the other side to fund private treatment if it will help you to recover. This usually happens in a case where the other side has admitted liability for the case and where you have had your medical report. The independent expert may say in their report that you will benefit from treatment to help you recover. As a claimant in a personal injury case, you do have a duty to help to mitigate your losses where you can. This means that you should undergo treatment where it’s recommended, and this may also be beneficial for the case.

You could obtain treatment with the NHS, but this isn’t always easy and it’s not always fast. As such, we can get the other side to agree to pay the costs of private treatment so you can get access to the help you need quicker. The other side has a duty to help you to get better as soon as possible too, so we can use this as justification for getting access to private treatment.

You could also pay for treatment yourself and then ask for the costs of the treatment to be a part of the final settlement as well. As long as the treatment is justified and you have a record of the costs, we can include it in a Schedule of Special Damages. When you make a claim, you can recover compensation for the pain and suffering of the injury, and for losses and expenses. These losses and costs can be an additional part of the case on top of the compensation for your injuries.

What if liability is denied in the case?

Where the opponent is defending the case, it’s not always possible to easily access private treatment with compensation claims that are being pursued. You have the option to pay for it yourself and then recover the costs if the case wins but you normally won’t be able to get that money back if the claim doesn’t succeed.

There are sometimes options where treatment providers can offer to fund the treatment on a No Win, No Fee basis. This can depend on the nature of the case and the provider or agency’s agreement to fund the costs this way. It’s not guaranteed, but it’s often something we can look at, particularly in cases where we feel we can succeed with the claim.
