Taxi accidents – making a claim

If you are a passenger in a collision whilst riding in a taxi, you should have a guaranteed claim for personal injury compensation if you are injured as a result. As a passenger, there isn’t normally a great deal you could have done to have contributed towards or prevented the accident. Most passengers in collisions have an almost guaranteed claim.

So what should you do about making a claim?

A common issue with these types of claims is not having the details of the driver at fault. If it’s the taxi driver, the best thing you can do it make a note of their registration number and cab / driver number details as these may be very useful for the claim.

If it’s another vehicle that’s at fault, make a note of their registration number or ask the driver of the taxi to give it you if they have made a note of it – hopefully they will have done so they can sort out vehicle damages through the insurers.

Unfortunately a lot of people don’t think to do any of this, which is understandable – but this can hamper a claim. With a registration number we can make an insurance database search and find out who the insurers are and submit a claim directly to them with no fuss or worries. But if we don’t have this vital information and therefore don’t know who the insurers are of whichever driver is at fault, we’re not going to be able to submit a claim right away.

It would be very helpful for you to contact the taxi company and get hold of this information. If they won’t give it to you, we will need to write to them and make a formal request on threat of court action to disclose it. This can be tricky, and this can take time – so you’d be wise to try and get the details yourself as it will save a lot of time at the start.

Even if you have the details of the taxi and they weren’t at fault, we can submit information to their insurers who should then direct us to the correct insurers of the other vehicle.

The key really is having at least one registration number of a vehicle involved.

What else do I need to do?

Seek medical attention, and contact us about making a claim on your behalf as soon as possible. We should certainly be able to offer you a No Win, No Fee agreement and we normally don’t take the full 25% from your claim that most other solicitors do thanks to legal changes that happened last year.
