Can I make a No Win, No Fee Claim?

A No Win, No Fee agreement should mean that you will not have to pay any legal fees to your lawyer if they take your case on and they are unable to secure a successful conclusion. The point of this is that you shouldn’t be at risk of losing thousands of pounds by making a claim that may not win.

Sometimes it’s just too difficult to know if you can win unless we go ahead and pursue the claim! So when can you make a No Win, No Fee claim?

If the answer to any of these questions is yes, you may have a claim for personal injury compensation:

  • Someone else is a at fault, or partially at fault, for the accident and injuries
  • Someone could have done something to have prevented the accident / injuries from happening

Ultimately, where there is blame, there may be a claim! I know that’s somewhat of a misused cliché nowadays, but the whole point in having the right to make a claim is when a person suffers injury and / or loss because of someone else’s negligence.

So if you have been injured and it may have been caused by negligence, and there is enough evidence based on the facts you present to a lawyer to show that there may have been negligence, that’s when a lawyer could offer you a No Win, No Fee claim.

If you were at fault, or there was nobody to blame at all, we probably wouldn’t offer you a No Win, No Fee agreement. It’s all about whether we have reasonable belief that we can make a successful claim.

What happens to our fees if we lose?

If we lose, we don’t get paid – but it’s a business decision for a law firm to offer a No Win, No Fee; so it’s our prerogative to take the risk of the case on. We can assess the risks at the start, and if we think we have a good enough chance of winning, we can offer the No Win, No Fee guarantee.

So yes, we do lose money on claims that we don’t win. But that’s our choice if we offer you a No Win, No Fee agreement.
