Can I make a claim for compensation?

It all depends on a few factors. Firstly, the accident or injuries have to have been caused through negligence. In short, someone, or some company, must have failed to do something that they can reasonably be expected to do, or have negligently done something and caused an accident or an injury.

There are genuine accidents – but if the accident caused was foreseeable, you may have a case.

If it’s something quite straightforward like being hit in the rear by another vehicle, we can usually tell you that the chances of winning are pretty strong and we can offer to begin your claim straight away! If you have tripped due a pothole, we may ask for photos first to assess whether we believe the defect would be classed as enough of a risk to pin the claim on the local highways authority.

Will I win my claim for compensation?

Essentially this comes down to two things – breach of duty and medical causation.

If we can prove that the Defendant breached any duty they have for you, like a supermarket failing to cordon off a wet floor or put up signs after mopping the floor, or if your employer failed to properly train you and risk assess a manual handling activity, we may be able to win the claim.

Secondly we have to prove that you have suffered a loss as a result of the breach of duty.

So if you have injured your back at work, we need a medical report to confirm that the back injury was caused by the accident and therefore the breach of duty.

If you were driving and someone drove in to the rear of your vehicle and you’re suffering from neck and back pain, then again we need a medical report to confirm that the neck and back pain was caused by the collision.
