Is it worth claiming for whiplash compensation?

chronic pain compensation

If you are reading this blog you may have just been diagnosed with whiplash and you may be wondering how much your claim may be worth, and if it’s worthwhile claiming at all. I’m here to give you an idea of how claims for whiplash are valued by a solicitor, and also to run you through some of the additional benefits you may receive by claiming:

Solicitors use a number of tools in which to value your claim for whiplash; I have gone on to list some of these below:

Medical reports

Further detail on medical reports can be found in our other blogs, but essentially they not only assess your injuries but also go into detail about the effects the injury has had on all areas of your life.

The medical report may also give recommendations for further treatment and/or reports to be done, and it may give a time period in which the medic believes your injuries will likely resolve. It’s for this reason that a medical report is so vital in valuing your claim.

Judicial Studies Board Guidelines

The JSB guidelines band neck injuries for the purposes of valuations as per below:

  • Minor Whiplash Injuries – £750 to £4,000
  • Moderate Whiplash Injuries – £4,000 to £8,000
  • Severe Whiplash Injuries – £8,000 to £85,000

It’s noteworthy that the average whiplash claim using a solicitor normally settles for around £2,500.

Case law

Your solicitor may look at cases which have already settled and are similar to your own in order to help in valuing your claim.

Skill, experience, and expertise of your solicitor will be beneficial and why it’s important to choose a specialist whiplash lawyer with a vast amount of experience to ensure you compensation claim is maximised.

Medical package

At The Injury Lawyers we are able to arrange private medical treatment at no cost to you right from the outset of the claim. This treatment can include physiotherapy, osteopathy, and chiropractic assistance – the cost of which, depending on whether you win or lose your case, is claimed back from the other side, or is recovered from insurance.

You may have also suffered a loss of earnings as a result of the accident, or incurred other losses which you may be able to claim back by beginning a claim.

If you require any further information then feel free to give The Injury Lawyers a call.
