Although your solicitor can give you an idea of whether your claim will be successful, <strong>it is rarely possible to be 100% certain<\/strong> unless you have been hit in the rear by another vehicle whilst stationary, or you were a passenger in a road collision.<\/p>\n<p>Legal aid for most <a href=\"http:\/\/www.theinjurylawyers.co.uk\/personal-injury-claims.php\">personal injury claims<\/a> was abolished in 2000 and a different way of funding these claims was introduced \u2013 the <a href=\"http:\/\/www.theinjurylawyers.co.uk\/no_win_no_fee.php\">no win, no fee<\/a> agreement.<\/p>\n<p>This is an agreement that means that, if your claim is not successful, <strong>you will not have to pay a penny to your solicitor for their fees<\/strong>. Under this agreement, if the claim is unsuccessful your solicitor will do the work for your claim without any payment from you for their fees;.\u00a0 The way that claims are now funded means that solicitors can charge an additional fee to the defendant \u2013 a \u2018<strong>success fee<\/strong>\u2019 \u2013\u00a0 when they win. This extra amount is used to pay for those claims that aren\u2019t successful. This means that there is <strong>no reason for a solicitor to charge you for their costs whether you win or lose<\/strong> and you should always avoid using a solicitor that will take any money out of your \u00a0<a href=\"http:\/\/www.theinjurylawyers.co.uk\/100-percent-compensation-4u.php\">compensation<\/a>.<br \/>\n<!--more--><\/p>\n<p>However, there is still the matter of the other side\u2019s costs. If they win, they will want to claim back their costs, just as your solicitor would if they had won. There are also other expenses, such as the cost of getting medical reports, and sometimes medical treatment which are known as \u2018disbursements\u2019.\u00a0<\/p>\n<p>When we take on claims, we don\u2019t just take those that we are sure will win. We also want to give people a chance to make a claim where the outcome is less than certain. As long as we think that there is more chance than not that the claim will succeed, we will do everything to make it successful. \u00a0<\/p>\n<p>To protect our clients from any costs if the claim does not succeed, we arrange insurance called \u2018<strong>after the event<\/strong>\u2019 insurance if you don\u2019t already have insurance to cover such costs. This covers the opponent\u2019s costs and any other expenses that have to be paid if your claim is unsuccessful.
