Many of these I will list below:<\/p>\n<p>1.<strong> Medical report<\/strong>: A medical report goes further than simply assessing your injuries &#8211; it can also contain the effects the injury has had on your <strong>work<\/strong>, <strong>social<\/strong>, and <strong>domestic life<\/strong>, as well as your hobbies. The medical report also gives a prognosis of when you are likely to recover from your injuries. This is key to helping your lawyer value your claim accurately.<br \/>\n<!--more--><\/p>\n<p>2. <strong>Judicial Studies Board Guidelines<\/strong>: The JSB guidelines band neck injuries for the purposes of valuations &#8211; I have set out these bands below;<\/p>\n<ul>\n<li>Minor Whiplash Injuries \u2013 <strong>\u00a3875 to \u00a35,150<\/strong><\/li>\n<li>Moderate Whiplash Injuries \u2013 <strong>\u00a35,150 to \u00a316,400<\/strong><\/li>\n<li>Severe Whiplash Injuries \u2013 up to <strong>\u00a397,000<\/strong><\/li>\n<\/ul>\n<p>3.\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Skill, experience, and expertise of your solicitor<\/strong>: this is why it can be beneficial to choose a specialist personal <a href=\"http:\/\/www.theinjurylawyers.co.uk\/\">injury lawyer<\/a> with a vast amount of experience in dealing with <a href=\"http:\/\/www.theinjurylawyers.co.uk\/whiplash_claims.php\">whiplash claiming<\/a>, as using this experience they may be able to maximise your compensation payout.<\/p>\n<p>4.\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Case law<\/strong>: your solicitor may look at similar cases to your own which have settled already in order to value your claim.<\/p>\n<p><strong>Your compensation explained&#8230;.<\/strong><\/p>\n<p>Compensation can also be called &#8216;<strong>damages<\/strong>&#8216;.\u00a0 There are two heads of damage which you can claim; these being <em>General Damages<\/em> and <em>Special Damages<\/em>. I will go onto explain these below:<\/p>\n<p>General Damages is compensation which you can claim for the injuries you sustained as a result of your accident. Your general damages claim covers:<\/p>\n<ul>\n<li><strong>Pain and suffering<\/strong>: This is the pain caused by your injury. Psychological suffering is also considered in this category.<\/li>\n<li><strong>Loss of amenity<\/strong>: Loss of amenity can cover a multitude of issues such as the effects your injury has had on many aspects of your life \u2013 at work, socially, and at home.<\/li>\n<\/ul>\n<p>Special damages aims to reimburse you for the financial losses suffered as a result of your accident. These losses are quantifiable and are collated in a document known as a Schedule of Loss. I have listed some of the more common types of special damages you may see in a Schedule of Loss below:<\/p>\n<ol>\n<li><strong>Loss of earnings<\/strong> \u2013 you may be entitled to claim this if you have been absent from work unpaid or on a reduced rate of pay due to your accident.<\/li>\n<li><strong>Care and Assistance<\/strong> \u2013 if you have required the assistance of a carer as a result of your accident, a fee can be claimed for them.<\/li>\n<li><strong>Treatment costs<\/strong> \u2013 costs of medical treatment for your injuries may be claimed.<\/li>\n<li><strong>Other<\/strong> \u2013 Travel costs and prescription costs, for example.<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>How is a whiplash claim valued?
