{"id":7230,"date":"2011-05-23T09:48:32","date_gmt":"2011-05-23T08:48:32","guid":{"rendered":"http:\/\/www.theinjurylawyers.co.uk\/injury-lawyers-blog\/?p=7230"},"modified":"2011-05-23T09:49:14","modified_gmt":"2011-05-23T08:49:14","slug":"car-accident-claims-%e2%80%93-hit-in-the-rear","status":"publish","type":"post","link":"https:\/\/www.theinjurylawyers.co.uk\/injury-lawyers-blog\/2011\/05\/23\/car-accident-claims-%e2%80%93-hit-in-the-rear\/","title":{"rendered":"Car Accident Claims \u2013 Hit in the Rear?"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.theinjurylawyers.co.uk\/injury-lawyers-blog\/wp-content\/uploads\/2011\/05\/car-braking-negligence2-300x225.jpg\" alt=\"\" title=\"car-braking-negligence\" width=\"300\" height=\"225\" class=\"alignright size-medium wp-image-7243\" \/>If you were correctly driving along, or you were sitting stationary in your vehicle, when rather annoyingly some other driver rams you up the backside, I have <strong><em>some good news and some bad news<\/em><\/strong> for you.<\/p>\n<p>I\u2019ll start with the bad \u2013 to get it over and done with \u2013 in the next few days (or even hours) you will probably start feeling <strong><em>pain, soreness, stiffness, and \/ or aches in your neck, shoulders, and back<\/em><\/strong>. This is called <em><a href=\"http:\/\/www.theinjurylawyers.co.uk\/whiplash_claims.php\">whiplash<\/a><\/em> \u2013 and it\u2019s an absolute pain to live with (I know \u2013 I\u2019ve currently got it as well thanks to my local bus service!).<\/p>\n<p>The common symptoms of whiplash are:<br \/>\n<!--more--><\/p>\n<ul>\n<li>Pain, stiffness, soreness, aches, and discomfort in the neck, back, and shoulder area (sometimes radiating down in to other areas)<\/li>\n<li>Reduced, or loss of mobility in the affected areas<\/li>\n<li>Pins and needles in the arms and other areas<\/li>\n<li>Headaches \u2013 sometimes even dizziness, sickness, and vertigo.<\/li>\n<\/ul>\n<p>It often feels like you\u2019ve slept awkwardly, or you\u2019ve strained your neck and back. In essence, you have strained the muscles in your neck and back. <strong><em>Whiplash is caused by the muscles, tendons, and ligaments in your neck and back being stretched beyond their normal range of movement<\/em><\/strong> from the force of the collision thrusting you forward. It\u2019s a rather complicated injury to live with, and it affects different people in different ways.<\/p>\n<p>So \u2013 bad news done with. What\u2019s the good news?<\/p>\n<p><strong><span style=\"text-decoration: underline;\">The good news is: You have a Claim for Compensation!<\/span><\/strong><\/p>\n<p>If the accident was not your fault, you can make a successful <a href=\"http:\/\/www.theinjurylawyers.co.uk\/100-percent-compensation-4u.php\">claim for compensation<\/a> for your injuries, financial losses (lost earnings, treatment costs, travel fares), and get access to private medical care.<\/p>\n<p><em>You have a claim! And as the other driver hit you in the back, you have a very straightforward claim!<\/em><\/p>\n<p>But wait! There\u2019s more bad news; and more good news as well&#8230; I will of course traditionally start with the bad news:<\/p>\n<p>As soon as you have your accident, you will probably be inundated with calls left right and centre from insurers, claims management companies, and solicitors all offering you their services. My simple advice is \u2013 ignore them all! If they\u2019re aware of your accident, it\u2019s because of the insurers (unless you\u2019ve made an enquiry with someone directly).<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Insurers<\/span><\/strong><\/p>\n<p>Ignore them. Do not allow the insurers for the driver at fault to offer you any money or services. You are dealing with the people who owe you money \u2013 <strong><em>they will try and under settle your claim<\/em><\/strong>. If they offer you a figure right from the outset, you are <strong><em>putting your claim and your health in danger by accepting it<\/em><\/strong>. These offers are pulled from thin air \u2013 the only way to value a case is with <strong><em>independent medical evidence<\/em><\/strong> and a <strong><em>fully qualified injury lawyer<\/em><\/strong> on your claim.<\/p>\n<p>If you accept their offer, you can\u2019t go back. If you\u2019re still suffering in a few months time, it\u2019s likely you\u2019ll have under settled your claim, and <strong><em>you won\u2019t be able to get access to private medical care or any more compensation<\/em><\/strong>. I\u2019m afraid it\u2019s a case of \u201chard luck\u201d if you\u2019ve fallen prey to the insurers already&#8230;<\/p>\n<p>Never let your own insurers refer your claim over to a solicitor either (normally through Legal Expense Insurance, or Motor Legal Protection). Your claim is basically sold on for a fee &#8211; your insurers are paid for providing your details to a solicitor. Your <strong><em>own insurers are making money from your claim for nothing<\/em><\/strong>. But that\u2019s not the worst part&#8230;<\/p>\n<p>The solicitor that buys your case will <strong><em>waste up to \u00a3800 on paying for your claim<\/em><\/strong>. This figure is not recoverable from the other side \u2013 in fact; we solicitors get fixed fees for <a href=\"http:\/\/www.theinjurylawyers.co.uk\/road_traffic_accidents.php\">road accident claims<\/a>. So&#8230; where does this cash come from?<\/p>\n<p>One of two places:<\/p>\n<ul>\n<li><strong><em>Your settlement figure<\/em><\/strong> \u2013 perhaps a <strong><em>percentage reduction<\/em><\/strong>, or a fee you have to pay up front or at the end of the claim.<\/li>\n<li><strong><em>Your service levels<\/em><\/strong> \u2013 your solicitor has <strong><em>wasted potentially 2\/3rds of their budget<\/em><\/strong> on buying your case. That doesn\u2019t leave them a lot to arrange your medical report, arrange your private treatment, research your claims value thoroughly, fight tooth and nail for the best payout for you, explore every avenue of losses to get you more compensation, keep you updated regularly, and go the extra mile for your claim, does it?<\/li>\n<\/ul>\n<p>So \u2013 avoid insurers: get your own independent personal <a href=\"http:\/\/www.theinjurylawyers.co.uk\/\">injury lawyer<\/a>. Which brings me on to my next point:<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Claims Management Companies<\/span><\/strong><\/p>\n<p>These chaps are <strong><em>not lawyers<\/em><\/strong>. They\u2019re agents that will \u2018<em>provide you with legal advice<\/em>\u2019 and then refer your claim over to a lawyer. But \u2013 they\u2019re certainly not a charity. They don\u2019t pass our details over to solicitors for free. They are of course, a business! So <strong><em>passing your details over to a lawyer will cost the lawyer some money. <\/em><\/strong><\/p>\n<p>As with the insurers, this only comes from one of two places:<\/p>\n<ul>\n<li><strong><em>Your settlement figure<\/em><\/strong><\/li>\n<li><strong><em>Your service levels.<\/em><\/strong><\/li>\n<\/ul>\n<p>So \u2013 What\u2019s that good news I mentioned ages ago?<\/p>\n<p><strong><span style=\"text-decoration: underline;\">The GOOD News<\/span><\/strong><\/p>\n<p>You\u2019re in no way obligated to go with the insurers or with their solicitors. You <strong><em>actually have complete freedom of choice to select any lawyer you like<\/em><\/strong>. It\u2019s totally up to you!
