What does it mean? Is it true that it does exactly what it says on the tin? I know it\u2019s a common term nowadays, but do any of you understand what it actually involves?<\/p>\n<p>There are actually multiple answers to this question \u2013 but realistically, it all comes down to which lawyer you choose to represent you.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">What Happens if You Lose?<\/span><\/strong><\/p>\n<p>If your <a href=\"http:\/\/www.theinjurylawyers.co.uk\/100-percent-compensation-4u.php\">compensation<\/a> claim fails to succeed, under a No Win No Fee, you should <strong><em>not be liable for any of your lawyer\u2019s fees<\/em><\/strong>. The reason I say <em>should<\/em> is because there are lawyers out there who are prepared to be sneaky and may try and get something out of you.<br \/>\n<!--more--><\/p>\n<p><strong><em>With a proper No Win No Fee \u2013 there are no costs to you whatsoever if the claim loses. <\/em><\/strong><\/p>\n<p>Simply put, your lawyers will <strong><em>only take on a claim if they think it has a good chance of winning<\/em><\/strong>. So, we don\u2019t expect to lose your case. That\u2019s why, and how, we can offer the <a href=\"http:\/\/www.theinjurylawyers.co.uk\/no_win_no_fee.php\">No Win No Fee<\/a>. We can also obtain insurance to cover any costs to ensure you are never charged.<\/p>\n<p>But anyway, enough with the depressing stuff &#8211; What about if your claim WINS!<\/p>\n<p><strong><span style=\"text-decoration: underline;\">If Your Claim Wins<\/span><\/strong><\/p>\n<p>Firstly, congratulations on being able to access the <a href=\"http:\/\/www.theinjurylawyers.co.uk\/100-percent-compensation-4u.php\">compensation<\/a> you thoroughly deserve. All that\u2019s left now is to settle an amount that reflects the severity and length of your pain, suffering, and loss of amenity.<\/p>\n<p>So, if your claim is a winner, what charges are you liable to pay your solicitor? Again, this all depends on the No Win No Fee lawyer you instruct for the case.<\/p>\n<div><strong><span style=\"text-decoration: underline;\">THE GENUINE NO WIN NO FEE<\/span><\/strong><\/div>\n<div><strong><span style=\"text-decoration: underline;\"> <\/span><\/strong><\/div>\n<p><strong><span style=\"text-decoration: underline;\"> <\/span><\/strong><\/p>\n<p><strong> <\/strong><\/p>\n<p><strong> <\/strong><\/p>\n<p>A <a href=\"http:\/\/www.theinjurylawyers.co.uk\/no_win_no_fee.php\">Genuine No Win No Fee<\/a> agreement is different to most others. Before I explain the difference, it\u2019s important to understand that, just because a solicitor says theirs is genuine, doesn\u2019t mean it is.<\/p>\n<p>A Genuine No Win No Fee agreement means <strong><em>your lawyer limits their legal fees in writing to whatever they recover from the other side<\/em><\/strong>. This means that <strong><em>your lawyers cannot charge you<\/em><\/strong> any of their fees for a successful claim.<\/p>\n<p>I can actually show you the difference right here:<\/p>\n<p><span style=\"text-decoration: underline;\">Genuine No Win No Fee<\/span>: \u201c<strong><em>If, for any reason, we are unable to recover our fees from your opponent, we shall NOT look to recover the fees from you<\/em><\/strong>.\u201d Notice the <em>NOT<\/em> in capitals? It\u2019s quite clear this means your lawyers can\u2019t charge you at all!<\/p>\n<p><span style=\"text-decoration: underline;\">Standard No Win no Fee<\/span>: \u201cwe will seek recovery of your legal fees from your opponent.\u201d The term \u201c<strong><em>seek<\/em><\/strong>\u201d means they will only try; so what happens if they don\u2019t get all of their fees back? You are liable for them!<\/p>\n<p>It may be even worse, and say \u201cif you win your claim, you pay our basic charges, our disbursements and a success fee. You are entitled to seek recovery from your opponent of part or all of our basic charges.\u201d This, in my opinion, is outrageous! It actually means that, in writing, you are responsible to recover your own solicitors\u2019 fees\u201d. They should have a costs department to deal with that.<\/p>\n<p>But hey \u2013 it can get worse! It may even have a clause in there to state \u201cif you receive provisional or interim damages, we may require you to pay our disbursements at that point.\u201d An interim payment is designed to help you out financially whilst the claim is going through the motions; what use is it if it\u2019s going to be used to pay your solicitors legal fees!?<\/p>\n<p>The point I\u2019m trying to make is: <strong><em>read any agreement thoroughly before you agree to it<\/em><\/strong>. If you question the solicitor about anything that makes you liable for costs, make sure they give you a straight answer; not \u201coh, we would never do that though\u201d, or \u201cit has to be worded that way\u201d.<\/p>\n<p><strong><em>The Genuine No Win No Fee means your lawyers cannot charge you for their fees for a successful claim.
