{"id":432,"date":"2009-07-07T16:28:10","date_gmt":"2009-07-07T15:28:10","guid":{"rendered":"http:\/\/www.theinjurylawyers.co.uk\/injury-lawyers-blog\/?p=432"},"modified":"2009-07-07T16:28:10","modified_gmt":"2009-07-07T15:28:10","slug":"are-you-a-worker","status":"publish","type":"post","link":"https:\/\/www.theinjurylawyers.co.uk\/injury-lawyers-blog\/2009\/07\/07\/are-you-a-worker\/","title":{"rendered":"Are You A Worker?"},"content":{"rendered":"<p>The Workplace Regulations are there to protect workers from <a href=\"http:\/\/www.theinjurylawyers.co.uk\/accidents_at_work.php\">accidents at work<\/a>.<\/p>\n<p>If you have an accident but are not a \u2018worker\u2019 then you are not likely to be able to claim under <em>The Workplace Regulations<\/em> but that doesn\u2019t mean you can\u2019t claim in another way. It just means that you can\u2019t benefit from this excellent bunch of regulations.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.theinjurylawyers.co.uk\/injury-lawyers-blog\/wp-content\/uploads\/2009\/07\/workers.jpg\" alt=\"workers\" title=\"workers\" width=\"500\" height=\"150\" class=\"alignnone size-full wp-image-433\" \/><br \/>\n<!--more--><\/p>\n<p>A particularly important case that outlines that the Workplace regulations are there to protect \u2018workers\u2019 only is \u2018<strong>Donaldson v Hays Distribution Services<\/strong>\u2019. In this case it was found that the 1992 Work Place Regulations did not extend to protect non-workers who are present in the workplace.<\/p>\n<p>The reasons they provided for making this decision are as follows:<\/p>\n<p>1. The Workplace Regulations were put in to place in order to protect workers<br \/>\n2. There is nothing within the Regulations which indicates that they should be extended to those on the premises as visitors, not workers<br \/>\n3. The idea of the Regulations was to \u2018supersede\u2019 those set out in occupiers\u2019 liability act, without the need to amend the act.<\/p>\n<p>In my mind the Workplace Regulations are quite extensive and from a legal perspective if a Client of mine is a \u2018worker\u2019 then it makes my job easier in <a href=\"http:\/\/www.theinjurylawyers.co.uk\/\">claiming compensation<\/a> for him\/her.<\/p>\n<p>There are so many regulations, I can usually find a breach but just remember you can only rely on these excellent Regulations if you are a \u2018worker\u2019 as defined under the Regulations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Workplace Regulations are there to protect workers from accidents at work.
