But the sad story is that the insurance companies are somewhat displeased that their heavily lined pockets are being ever so slightly dented with claims against their policy holders; which in itself is a bit of a conundrum, given that the insurance product they sell is designed to insure people!<\/p>\n<p>So, the insurance companies have for many years now being finding ways to save themselves some money \u2013 which unfortunately can end up having a serious negative effect on a <a href=\"http:\/\/www.theinjurylawyers.co.uk\/personal-injury-claims.php\">claim for personal injury<\/a>.<\/p>\n<p>But how?<\/p>\n<p>Well, the insurance companies\u2019 involvement is normally <strong><em>known as Legal Expense Insurance<\/em><\/strong> \u2013 so here\u2019s the real explanation as to what exactly Legal Expense Insurance is:<br \/>\n<!--more--><\/p>\n<p><strong><span style=\"text-decoration: underline;\">Legal Expense Insurance<\/span><\/strong><\/p>\n<p>If you are ever unfortunate enough to be in a road accident, it\u2019s likely your insurers will contact you and advise you that you have the benefit of Legal Expense Insurance, which provides legal representation at no cost for you! You may have even being paying for it as part of your policy. But exactly what is Legal Expense Insurance?<\/p>\n<p><strong><em>Well, in short \u2013 Legal Expense Insurance is the \u201cgreat insurance scam\u201d&#8230;<\/em><\/strong><\/p>\n<p>All your insurance company actually does is <strong><em>refer your claim to one of their \u201capproved\u201d panel solicitor firms<\/em><\/strong>. Of course, when I say refer, what I actually mean is sell \u2013 yes, they <strong><em>sell your claim on to a solicitor for a referral fee<\/em><\/strong>. Not only that, but because they have a panel of them, it\u2019s <strong><em>the highest bidding law firm that gets the case!<\/em><\/strong> But what does this mean for you and your claim?<\/p>\n<ol>\n<li>\u00a0The solicitor you are referred to \u2013 you have had no choice in the matter; how can you trust them to be a firm with your interests at heart?<\/li>\n<li>\u00a0The firm you get will be the highest bidder \u2013 i.e. the one that\u2019s <strong><em>paid the most amount of money to buy your claim<\/em><\/strong>. Sadly for them, these <strong><em>referral fees are not recoverable <\/em><\/strong>from the other side.<\/li>\n<\/ol>\n<ul>\n<li>So, where does their money come from? <strong><em>The money comes straight out of the budget \/ running costs for your case<\/em><\/strong>. This leaves you with a <strong><em>solicitor that already has less money to spend on you and your claim<\/em><\/strong> right from the start \u2013 in fact, they can pay anywhere up to \u00a3800 just to buy your case.<\/li>\n<li><strong><em>\u00a3800 is more or less the base running costs for a straight forward claim for compensation. That <span style=\"text-decoration: underline;\">potentially leaves your solicitor with a budget of nothing!<\/span><\/em><\/strong><\/li>\n<li>If your claim has been passed over for a referral fee, they are duty bound to inform you in some way \u2013 whether by phone, or whether it\u2019s hidden in the small print of their paperwork.<\/li>\n<li>Lastly, your <strong><em>insurance company profits from absolutely nothing!<\/em><\/strong> In fact, they are in the money even more if you have being paying for Legal Expense Insurance as part of your policy.<\/li>\n<\/ul>\n<p>\u00a0So, what does this mean for your claim:<\/p>\n<ol>\n<li>With <strong><em>less money to spend on the case, the service levels they provide are poor<\/em><\/strong>. I can say this with a degree of confidence given that we often receive calls from people who have gone down this route, and they all have common complaints:\n<ol>\n<li><strong><em>Solicitors not calling them back<\/em><\/strong> \u2013 or any call backs never being returned.<\/li>\n<li><strong><em>Concerning low levels of contact with clients<\/em><\/strong> \u2013 at worst, I have heard people complain of months going by without knowing what\u2019s going on with their case.<\/li>\n<li><strong><em>Unqualified \/ inexperienced claims handlers<\/em><\/strong> dealing with your case.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><em>You <strong><span style=\"text-decoration: underline;\">should have a fully qualified specialist injury solicitor<\/span><\/strong> representing you for your case, with years and years of knowledge and experience in dealing with personal injury claims. You should <strong><span style=\"text-decoration: underline;\">always have your calls returned<\/span><\/strong>, and your solicitor should make every effort to keep in regular contact with you \u2013 e.g. <strong><span style=\"text-decoration: underline;\">we contact our clients as a minimum of every 14 days<\/span><\/strong>.<\/em><\/p>\n<ol>\n<li><strong><span style=\"text-decoration: underline;\">Less compensation<\/span><\/strong> \u2013 yes, it is more than plausible. With a solicitor that has hardly any money to spend on your case, you must ask yourself the question: how hard are they willing, or able, to fight to ensure you get the maximum compensation you are entitled to receive by law? Have they ensured to endeavour to recover all of your losses? \u2013 e.g. lost earnings, private medical treatment, and care and assistance from family members or friends?<\/li>\n<\/ol>\n<ul>\n<li><strong><em>The truth is, with less money to spend on your case, they have less money to actually fight harder to maximise your payout .This means less compensation for you&#8230;<\/em><\/strong><\/li>\n<\/ul>\n<p>And why does this happen? Because your <strong><em>solicitor has wasted so much of their budget that they cannot afford to provide you with the high service levels you deserve<\/em><\/strong>. They cannot afford to fight hard to ensure you get the maximum compensation you are entitled to receive.<\/p>\n<p><strong><em>Simply put, they don\u2019t have the money to provide you with a great service, and they don\u2019t have the money to fight hard for your claim.<\/em><\/strong><\/p>\n<p>It\u2019s a recognised problem; and although it isn\u2019t illegal to buy and sell claims around, <strong><em>we don\u2019t believe it is ethical practice<\/em><\/strong>. All of our <strong><em>clients come directly to us<\/em><\/strong>, which means <strong><em>we can afford to spend much, much more on their claim<\/em><\/strong> to ensure they get a great service and the best compensation payout.<\/p>\n<p><em>In fact, the <strong><span style=\"text-decoration: underline;\">Law Society and the Barristers Council have recommended that referral fees be stopped<\/span><\/strong>, on the grounds that they have the potential to <strong><span style=\"text-decoration: underline;\">limit access to justice<\/span><\/strong> and <strong><span style=\"text-decoration: underline;\">reduce the quality of legal services<\/span><\/strong><span style=\"text-decoration: underline;\"> <\/span>on offer.
