Medical devices are of course products that are subject to the same legislation.<\/p>\n<p>You actually have some fairly solid rights under UK law when it comes to product recall claims, so read on for a bit of an insight in to this.<br \/>\n<!--more--><\/p>\n<h2 class-\"h3\">Your rights explained<\/h2>\n<p>The law we typically use here is <strong>Supply of Goods and Services Act<\/strong>, and the key elements of this legislation mean that products should be:<\/p>\n<div class=\"well\">\n<ul>\n<li>Of satisfactory quality<\/li>\n<li>Fit for purpose<\/li>\n<li>As descried or expected<\/li>\n<\/ul>\n<\/div>\n<p>So in essence if the product is defective in any way and this has caused you harm then these regulations are very useful indeed. They often imply an almost strict liability on the supplier of the product to you which means it\u2019s very difficult for them to defend a case. <strong>If a product is defective, then it is defective<\/strong>.<\/p>\n<p>The product must be as described as well so if it is not what you expected and this has resulted in harm to you then you have rights to claim in the same way.<\/p>\n<h3 class-\"h3\">Who do I claim from for product recalls?<\/h3>\n<p>This is the key element \u2013 with most products being manufactured abroad these days it isn\u2019t very easy to pursue a foreign manufacturer. But this is where the Supply of Goods and Services Act reigns supreme in terms of useful legislation!<\/p>\n<p>You may have spotted that a key word in the law here is the \u201csupply\u201d of goods and services. That means that the <em>supplier<\/em> of a product can be jointly liable if it is either defective, not fit for purpose, or not as described.
