We do get a lot of enquiries from people who have fallen down on buses because the driver has set off before they have had the opportunity to seat themselves down. It’s frustrating, but it doesn’t necessarily mean you are entitled to make a claim for personal injury compensation.<\/p>\n

But what about when it’s the case of an elderly person? Should a bus driver wait for an elderly person to be seated before setting off?

Firstly bus drivers do not have to wait for a person to be seated before setting off. People are allowed to stand on most buses anyway and rails and holds are there for use. But this is different for an elderly person.<\/p>\n

Where a person is elderly and \/ or clearly someone vulnerable due to obvious and noticeable mobility and balance problems, our argument is that the bus driver should give them the opportunity to be seated.
