\"\"According to the BBC, Crystal Wells, 47 was successful in her assertion that the Princess Alexandra Hospital in Harlow was negligent over the death of her husband, Peter Wells, in 2005.<\/p>\n

A High Court in London heard that Mr Wells died from a \u201creversible and treatable condition\u201d.<\/p>\n

The hospital admitted negligence over his death and apologised to the family.
\n<\/p>\n

Mr Wells had gone to hospital after suffering respiratory failure following a persistent cough. His life could have been saved and he could have made a full recovery had a tube been inserted in to him with which to aid his breathing.<\/p>\n

The barrister representing Mrs Wells stated that \u201cMr Wells did not get the treatment he was entitled to expect. It is a matter of profound regret.\u201d<\/em><\/p>\n

Ms Wells was entitled to make a claim on her late husband\u2019s behalf under the Fatal Accidents Act 1976. It states that an action can be brought on the deceased\u2019s behalf by anyone who falls within the category of a dependant.\u00a0 <\/p>\n

As Mr Wells\u2019 wife at the time of his death, Ms Wells fell within that category and was entitled to receive compensation for his injuries<\/strong>. It is fortunate that such a provision exists, as often where a fatal accident occurs it is not only a loss emotionally but also financially, with the deceased having provided a proportion of the income for the family.
