Well, No Win No Fee is supposed to be a guarantee that if you are unsuccessful in your claim you will not be charged a penny by your law firm. A No Win No Fee guarantee is given if the law firm dealing with your case believe it’s a case they can win. At The Injury Lawyers we ONLY take on cases we think we can win so we can normally offer a No Win No Fee Guarantee. Basically, a No Win No Fee guarantee is supposed to mean that when a law firm that accepts your case and you are charged upfront costs and will write off their fees if the claim doesn’t win.

Are they good news for the claimer?

This is a good thing for the person making the claim as it means that you should not be landed with a hefty bill for legal fees if the claim loses. With a Genuine No Win No Fee Policy such as the one offered by us, it will never be the claimer who loses money if the case is unsuccessful as we can write off our legal fees. Win or lose, they have made the right choice by making the claim with a No Win No Fee policy as there shouldn’t be any risk of having to pay for legal fees in the event that the case does not succeed.

What’s the difference between a Genuine No Win, No Fee Policy and Others?

It’s actually somewhat of a term we have coined, and we define it as follows:

The difference, plainly put, is that a Genuine No Win No Fee Policy means that you, the claimer, won’t have to pay any deposit or upfront costs whatsoever to cover the firm if you lose the case. On top of that it also means you have nothing to pay at the end of an unsuccessful claim.

Some other firms claim to use No Win No Fee policies but will actually charge you up to £1,500 upfront before they actually accept the case! Another scheme they use is to charge you nothing upfront but to charge fees for expenses such as paying for private medical advice etc. which can mount up to a hefty cost to you if the case isn’t a success! So, put short, a Genuine No Win No Fee should mean you pay the Firm absolutely nothing from start to finish of the process if it results in an unsuccessful claim. This is the right way to offer a No Win No Fee Guarantee and is what we will normally offer you.

How does this affect my claim if I win?

To be honest, it doesn’t at all. If you have a successful case then it will go through the process of success fees or other agreements which you can read about in our other blogs. The No Win No Fee Policy should be there purely to protect you, the claimer, from any costs if the case is not win. What happens if you win is a totally separate issue to the no win no fee part of an agreement.

A question that a lot of people ask is what exactly does No Win No Fee mean?
