The Rules<\/span><\/b><\/p>\n

The Workplace (Health, Safety and Welfare) Regulations 1992 is an important set of regulations that cover many general areas of workplace health and safety. There is a specific section (Regulation 12) that addresses the condition of walkways and traffic routes. This states:<\/p>\n

(1)\u00a0 Every floor in a workplace and the surface of every traffic route in a workplace shall be of a construction such that the floor or surface of the traffic route is suitable for the purpose for which it is used.<\/i><\/p>\n

This generally addresses the issue of making sure that an employee can navigate the workplace safely. You wouldn\u2019t want an uneven and dangerous office or warehouse where a person could trip or fall because the ground was uneven, steep, or difficult to walk on. So to enforce this, the above regulation puts the duty on the employer to make sure that steps are taken to prevent such accidents.<\/p>\n

Specifically, a further section states:<\/p>\n

(2) (a) the floor, or surface of the traffic route, shall have no hole or slope, or be uneven or slippery so as, in each case, to expose any person to a risk to his health or safety; <\/i><\/p>\n

The regulations go on to address the issue of substances or articles that could cause a slip, trip, or fall. It\u2019s no good having perfectly even walkways if you\u2019re going to allow liquid to accumulate and pose a slipping hazard, or allow debris or boxes to become trip hazards:<\/p>\n

(3) So far as is reasonably practicable, every floor in a workplace and the surface of every traffic route in a workplace shall be kept free from obstructions and from any article or substance which may cause a person to slip, trip or fall.<\/i><\/p>\n

Enforcing the above part is more about policies and procedures in the workplace. This requires training staff and enforcing inspection and maintenance regimes to look out for hazards and rectify them immediately. For example, warehouses will normally have designated walkway areas painted with lines were boxes are not allowed to be placed or to accumulate. When it comes to spillages, inspections at regular intervals can look out for hazards and rectify them. Specific bins or containers can be used for waste packaging to prevent debris accumulating on the floor as well. There\u2019s lots that can be done.<\/p>\n

Enforcing the rules is down to the employer, and for the most part it isn\u2019t difficult to achieve. But if you slip, trip, or fall because your employer hasn\u2019t taken the reasonable steps required of them by law, that\u2019s when you can make a successful claim for personal injury compensation.<\/p>\n
