So how about <strong><em>sticking accelerator pedals<\/em><\/strong> \u2013 that important enough for you?<\/p>\n<p>According to sources form the BBC (<a href=\"http:\/\/news.bbc.co.uk\/1\/hi\/business\/8473789.stm\">source<\/a>) <strong><em>Toyota has announced<\/em><\/strong> <strong><em>another recall on top of its already growing list<\/em><\/strong>, after it has been found that certain models <strong><em>pedal mechanism is becoming warn; sometimes to the extent of the pedal \u00a0getting stuck! <\/em><\/strong>So far the recall has only been announced in the US, and it is currently unknown if any other countries have been affected.<\/p>\n<p><strong><em>According to the report, the models affected include <span style=\"text-decoration: underline\">2009-2010 RAV4<\/span>, the <span style=\"text-decoration: underline\">2009-2010 Corolla<\/span>, the <span style=\"text-decoration: underline\">2009-2010 Matrix<\/span>, the <span style=\"text-decoration: underline\">2005-2010 Avalon<\/span>, the <span style=\"text-decoration: underline\">2007-2010 Camry<\/span>, the <span style=\"text-decoration: underline\">2010 Highlander<\/span>, the <span style=\"text-decoration: underline\">2007-2010 Tundra<\/span>, and the <span style=\"text-decoration: underline\">2008-2010 Sequioia<\/span>. \u00a0<\/em><\/strong><br \/>\n<!--more--><\/p>\n<p>The car giants have advised that \u201cin rare instances\u201d the models affected are <strong><em>subject to the pedal to \u201cmechanically stick(ing) in a partially depressed position or return slowly to the idle position&#8221;.<\/em><\/strong> Back in October, Toyta reportedly recalled 4.2 million US models because the pedal mechanism was becoming <strong><em>lodged under floor mats<\/em><\/strong>; it is claimed however that the two defects are unrelated.<\/p>\n<p>In August last year, 690,000 models in China were recalled due to <strong><em>faulty electric window switches<\/em><\/strong>. It appears that Toyota is having more than just the odd mechanical problem given these numerous recalls; so where does this leave the consumer?<\/p>\n<p>Well, <strong><em>manufacturers have a significant duty of care to ensure that their products can not cause the users to come to harm<\/em><\/strong>. Failing this is breach of contract under the <strong><span style=\"text-decoration: underline\">Sale of Goods &amp; Services Act 1982<\/span><\/strong>, (See <a href=\"http:\/\/www.opsi.gov.uk\/RevisedStatutes\/Acts\/ukpga\/1982\/cukpga_19820029_en_5\">source<\/a> for further information) and the manufacturer and \/ or the providers are <strong><em>liable for any injuries caused as a result<\/em><\/strong>.<\/p>\n<p>The recalls are evidently important given the nature of the defect; it\u2019s clear it could potentially lead to a <strong><em>serious accident<\/em><\/strong> if the accelerator mechanism fails to operate safely.
