Training and supervision – a lack of it leads to accidents!

We take on and win a lot of claims for work accident compensation when the victim has been exposed to risk through a lack of training and supervision. A new employee to the business is normally at a far greater risk with their lack of knowledge of the workplace and systems, and it takes a higher duty of care on the part of the employer to ensure they are looked after.

So if you have been injured as a trainee due to a lack of training or due to inadequate supervision, read on for advice below.

There are a large number of workplace health and safety regulations that employers must abide by. Many of the individual regulations that cover things like work equipment, manual handling, and personal protective equipment cover the element of training and supervision. After all – how would someone know how to use machinery correctly or carry large objects safely without the knowledge to do so? There is no excuse when it comes to ignorance of the law for training and supervision.

Where training is not provided or is not provided properly people are at risk. If an employee is injured as a result of this then they have the right to make a claim for personal injury compensation.

Where supervision is not adequately conducted – particularity where employees need to adapt to a dangerous situation – similar rules apply. You can’t just train someone and expect them to be able to follow and fully understand the ways of working immediately as it often takes time. The necessity for adequate supervision is key but is often neglected. Know your rights – you may have a successful claim for poor supervision!

How do I make a workplace claim for lack of training or supervision?

In most circumstances we need to submit a claim form either directly to your employer or to their insurers. They have to investigate the case and confirm whether they are prepared to admit they have breached the law and are responsible for compensating you. If they are, it is down to us as your lawyers to prepare your case for negotiations using specialist medical evidence to support your claim.

We as workplace compensation specialists are ideally placed to be able to efficiently pursue your claim and maximise the settlement where the case is successful. Our decades of experience means you can trust us to fight tooth and nail for your right to compensation.
