Knee Injury Claim Amounts

How much are you entitled to claim for if you sustain injury to your knee? Well it all depends on the nature and severity of the injury. When it comes to knees, they can range from a simple twist and strain that leaves you uncomfortable and limping for a few weeks, to ligament ruptures requiring surgical reconstruction and a permanent weakness. It really all does come down to the nature of the injury.

The only way to properly value a knee injury compensation claim is to instruct an expert lawyer and see a suitable expert for a medico-legal appointment. A report from the appointment will then be used by the lawyers to value the injury.

But in the meantime, here is a little guidance based on the official guidelines that are used to value knee injury claims:

Moderate Knee Injuries – Up to around £20,000

Typically these involve dislocation, torn cartilage or meniscus injuries which lead to weakness and mild disability in the future. Injuries that accelerate pre-existing injuries are also included in this bracket.

Injuries that resolve completely and quickly such as lacerations or minor twisting and soft tissue damage may only reach up to around £4,000.00.

Severe Knee Injuries – Up to around £30,000

Some severe injuries, such as damage to the knee cap and / or ligament / meniscal injuries or muscular wasting, that cause continuing pain and limitation of movement, with risk of degenerative changes in the future, will normally fall within this category.

Higher End Severe Knee Injuries – Up to around £70,000

This typically involves disruption of the joint such as dislocation resulting in severe ligament damage – normally ruptures and reconstruction surgery using autographs or arthrodesis – or fractures extending to the knee joint. Considerable pain and treatment with some permanent loss of function expected.

Where your knee injury fits within the brackets is entirely dependent on a number of factors:

  • The extent and severity of the damage.
  • The longevity of pain, suffering, and loss of amenity.
  • Whether there is any permanent weakness or continued disability caused by the injury.
  • Whether you will suffer from future degenerative changes caused by the injury.
  • The affect on your lifestyle – if you were more active and your injury affected you playing sports, this is taken in to account.
  • Your losses – such as lost earnings, medical expenses, travel expenses, and care and assistance claims.
