Expert Advice for Slip and Trip claims!

I bet a lot of you out there feel embarrassed or silly if you have a slip or trip in a public place; I know I do. But if the reason for your accident was caused by someone else’s negligence, we at The Injury Lawyers believe you may have a claim for compensation.

An accident can occur at any place or at any time and can cause serious injury. An innocent trip to the supermarket can sometimes end in a trip to A+E due to the carelessness of the supermarket! For example: failing to mop up spilt liquid on the floor can cause you or anyone else to slip on the hard floor and end up with a serious injury or broken bones.

Establishments should have procedures in place to avoid such events happening – but these procedures are not always adhered to in the way they should. In this instance, we believe you could have a slip or trip compensation claim.  In order for your claim to be successful we have to prove that the premises in which the incident took place have failed in their duty of care to look after you.

Understanding the Occupiers Liability Act

This law, in simple terms, means that any public premises has a duty of care to make sure that any hazards that could potentially cause injury are minimised. An example of this is having a set cleaning regime in place that is adhered to at all times. If the premises have failed to keep to the cleaning regime, there could be a claim to make.

In the first instance, always make sure that your injury has been reported to a member of staff on duty. No matter how minor you think your injuries are – and also try to see if there were any witnesses to the incident. A witness can be anyone who may have seen your accident happen, or even if they witnessed the hazard that caused you to slip or trip beforehand. It is always helpful as evidence to support your claim. The more witness statements we can get, the better.
