RTA claim involving learner drivers

If you’ve been involved in a road traffic accident (RTA) with a learner driver that’s caused you injury and it wasn’t your fault then you may be entitled to claim compensation!

A lot of drivers are unaware of the fact that learner drivers, even though they’re less experienced, still owe the same standard of care as fully qualified drivers when using the road. However, other road users are still expected to treat learner cars with caution if they approach them on the roads.

Learner drivers using motor vehicles on the road must not do so without supervision. They must be accompanied by an instructor, normally from a driving school. However they are also allowed to drive without a driving school instructor as long as the person supervising them is at least 21-years-old and has had a full UK driving licence for over three years.

When driving a vehicle, learner drivers must also be clearly displaying red ‘L’ plates. This warns other drivers that they are likely to make mistakes, and gives them the distance they require.
